Hostolute legal documents for our website, hosting, and related services.

These Terms & Conditions (“Terms”) form a legally binding agreement between you and Webolute FZE, trading as Hostolute (“Hostolute”, “we”, “us”, or “our”). They govern your access to hostolute.com and any related websites, applications, checkout flows, and customer portals (together, the “Website”), and your purchase or use of our products and services.

1. Who we are

Hostolute is a brand of Webolute FZE, a company established in the United Arab Emirates. Our registered correspondence address is Business Centre, Sharjah Publishing City Free Zone, Sharjah, United Arab Emirates.

We provide professionally designed website packages, web hosting, domain registration, SSL certificates, business email, website deployment, and related digital services.

These Terms should be read together with our Privacy Policy, Cookie Policy, Refund Policy, and Service Agreement. If there is a conflict relating to a paid service, the Service Agreement and Refund Policy control for that subject. If there is a conflict relating to personal data, the Privacy Policy controls.

2. Acceptance of these Terms

By visiting the Website, creating an account, submitting an enquiry, or placing an order, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Website or our services.

If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. In that case, “you” and “your” refer to that entity.

Electronic acceptance at checkout, including ticking an acknowledgement box, constitutes your signature for the purposes of applicable UAE electronic transactions laws.

3. Eligibility

Our services are intended for individuals and businesses capable of entering into a binding contract. You must be at least 18 years of age. You must provide true, current, and complete information and keep that information updated.

We may refuse, suspend, or cancel an order or account if we reasonably believe the information supplied is false, the transaction is high-risk, or the intended use would breach these Terms, applicable law, or third-party rules (including domain registry and payment-network rules).

4. Accounts and security

You are responsible for maintaining the confidentiality of your login credentials, control panel access, domain credentials, and any API or email passwords issued to you. You must notify us promptly at [email protected] if you suspect unauthorized use of your account.

You are responsible for all activity under your account, except to the extent caused by our proven negligence. We may require identity, billing, or business verification before provisioning or restoring services.

5. Services

Hostolute services may include, depending on the product purchased:

  • Ready-to-launch website packages with branding customization and deployment
  • cPanel and related web hosting
  • Domain name search, registration, renewal, DNS, and transfer support
  • SSL certificates
  • Business email mailboxes
  • Website migration assistance and optional maintenance add-ons

Service descriptions, features, and prices on the Website are invitations to treat and may change. An order is accepted only when we confirm acceptance and payment is successfully received, or when we begin provisioning, whichever occurs first. We may decline an order without liability if a product cannot be provisioned, a domain is no longer available, or payment cannot be verified.

6. Website packages

Website packages are template-based solutions customized with your branding, content, and business details. Unless a written statement of work says otherwise:

  • Delivery depends on you providing logos, copy, images, product information, and timely feedback.
  • Reasonable branding customization is included. Material redesign, custom application development, or features not described at purchase are out of scope and may be quoted separately, including through Webolute.
  • If you do not supply required materials within 30 days of our request, we may pause the project. Fees already paid remain payable.
  • First-year hosting, SSL, and a domain (where included in the package you selected) are subject to the terms for those products, including registry rules and renewal pricing.

We retain all intellectual property in our templates, layouts, code, libraries, design systems, and tools. You retain ownership of your own content, trademarks, and materials. Upon full payment, we grant you a non-exclusive, non-transferable licence to use the customized website for your own business while the applicable hosting or licence remains active. You may not resell, redistribute, or reuse the underlying template for other customers or competing products.

7. Hosting, email, and SSL

Hosting is provided on a shared or allocated infrastructure basis as described in the plan you purchase. Resource limits, inode limits, email sending limits, and security rules apply. We may throttle, suspend, or relocate services that jeopardize platform stability or other customers.

Daily backups, malware protection, SSL, and similar features are provided on a commercially reasonable basis. They are not a substitute for your own backups, security hygiene, or compliance obligations. Restore points may not be available for every file, mailbox, or time period.

SSL certificates and business email may be supplied by us or by third-party issuers and mailbox providers. Issuance, validation, and continued operation may depend on domain control, DNS configuration, and the third party’s terms.

Additional operational terms, including uptime targets and support hours, are set out in the Service Agreement.

8. Domain names

Domain availability shown during search is indicative only and may change before registration is completed at the registry. A domain is not registered until the registry accepts it and we confirm success.

Domain registrations, renewals, transfers, WHOIS data, and disputes are subject to the rules of ICANN (where applicable), the relevant registry, and our registrar partners. You must provide accurate registrant data and keep it current. You are the registrant of record unless we expressly agree otherwise in writing.

You must renew domains before expiry. We may send renewal reminders as a courtesy, but you remain responsible for renewal. Expired domains may enter redemption or be released. Fees for redemption, restore, or aftermarket recovery, if available at all, are additional and not guaranteed.

9. Orders, prices, and taxes

Prices are displayed in the currency you select on the Website. The default billing currency is United Arab Emirates Dirhams (AED). Displayed prices may exclude or include taxes as shown at checkout. Where VAT or other taxes apply under UAE or other law, they will be charged in addition or as displayed.

Introductory, first-year, or promotional prices apply only to the initial term stated at checkout. Renewal prices may be higher and are shown or linked at purchase where available. We may change renewal prices on notice before the next billing date.

Unless required by law or our Refund Policy, prepaid fees are non-refundable after provisioning starts.

10. Payment

Card and eligible payment methods are processed by Stripe and, where relevant, our billing platform. Hostolute does not store full card numbers on its own servers. Payment processing is also subject to Stripe’s terms and your card issuer’s rules.

You authorize us to charge the payment method supplied for the initial order and for recurring renewals of hosting, domains, email, SSL, maintenance, and other subscription services until cancelled in accordance with these Terms. Failed payments may result in suspension, non-renewal of a domain, or termination.

Chargebacks, payment disputes, or reversed payments without first contacting us may be treated as a material breach. We may suspend services, recover our costs, and report fraud where appropriate.

11. Renewals and cancellation

Subscription services renew for successive terms equal to the original billing term unless you cancel before the renewal date, or we notify you that a service will not renew. You may request cancellation by emailing [email protected] from the registered account email.

Cancellation stops future renewals. It does not, by itself, entitle you to a refund of the current term. Refund eligibility is governed by the Refund Policy.

On cancellation or expiry, we may delete websites, files, mailboxes, and backups after a short retention period. Export any data you need before the service ends.

12. Acceptable use

You must not use the Website or any Hostolute service to:

  • Violate any applicable law, regulation, or third-party right
  • Publish, store, or transmit unlawful, defamatory, obscene, hateful, or exploitative content, including child sexual abuse material
  • Distribute malware, phishing, spam, or unsolicited bulk email
  • Infringe copyright, trademarks, or other intellectual property
  • Attempt unauthorized access to systems, accounts, or data
  • Interfere with network security, other customers, or platform stability
  • Operate high-risk activities without our prior written consent, including crypto mining, open proxies, or traffic flooding
  • Resell services except under a written reseller or partner agreement with us

We may investigate suspected abuse, remove content, suspend services, and report activity to registries, payment providers, or authorities. We have no obligation to monitor customer content, but we may do so where reasonably necessary for security, legal, or operational reasons.

13. Customer content and licences

You retain ownership of content you upload or supply (“Customer Content”). You grant Hostolute a worldwide, non-exclusive licence to host, copy, transmit, back up, and otherwise process Customer Content solely to provide, secure, and support the services.

You represent that you have all rights needed to supply Customer Content and that it does not infringe third-party rights or applicable law. You are responsible for notices, licences, and consents required for your website, marketing, and customer data.

14. Third-party services

Parts of the service depend on third parties, including domain registries and registrars, certificate authorities, payment processors, cloud infrastructure, email filtering, and Google reCAPTCHA. Their terms, availability, and acts or omissions are outside our full control. We are not liable for registry rejection, registrar downtime, payment-network failure, or a third party’s change of policy, except to the extent we failed to exercise reasonable care in selecting or instructing that provider.

15. Affiliate and partner programmes

If you join a Hostolute affiliate or partner programme, additional programme terms apply. Commission is payable only on qualifying, paid, and non-refunded orders as described in those terms. We may withhold or reverse commission for fraud, self-referral, or cancelled orders.

16. Suspension and termination

We may suspend or terminate services immediately if:

  • You breach these Terms, the Service Agreement, or the Acceptable Use rules
  • Payment is overdue, reversed, or reasonably suspected to be fraudulent
  • Your use threatens security, legal compliance, or other customers
  • We are required to do so by law, a registry, a court, or a payment network

We may also discontinue a product on reasonable notice. Where practicable, we will offer a migration path or a pro-rata credit for unused prepaid hosting time, excluding domains, SSL, and other non-refundable items.

Clauses that by their nature should survive (including payment, IP, acceptable use, liability, indemnity, and governing law) remain in force after termination.

17. Warranties

The Website and services are provided on an “as available” basis. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

We do not warrant that a website will achieve any particular search ranking, revenue, or business result, or that hosting will be free of all downtime, attacks, or data loss.

Nothing in these Terms excludes liability that cannot be excluded under applicable UAE law, including liability for fraud or personal injury caused by our negligence.

18. Limitation of liability

To the maximum extent permitted by law, Hostolute and Webolute FZE are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, lost data, replacement costs, or reputational harm, even if advised of the possibility.

Our total aggregate liability arising out of or relating to the Website or a paid order is limited to the fees you actually paid to us for the affected service during the 12 months before the claim. If no fees were paid, our liability is limited to AED 500.

These limits apply regardless of the legal theory (contract, tort, statute, or otherwise) and are an essential basis of our pricing.

19. Indemnity

You will indemnify and hold harmless Webolute FZE, Hostolute, and our officers, employees, and contractors against claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from Customer Content, your websites or emails, your breach of these Terms, your violation of law or third-party rights, or a dispute relating to a domain you instructed us to register.

20. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including utility or internet failure, DDoS attacks, registry or cloud-provider outages, war, terrorism, epidemic, labour dispute, fire, flood, or government action.

21. Changes to these Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated date. Material changes to paid services will apply from the next renewal or after reasonable notice, except where a change is required by law or needed to address a security or operational risk. Continued use after the effective date constitutes acceptance.

22. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates, as applied in the Emirate of Sharjah. The courts of Sharjah have exclusive jurisdiction, without prejudice to our right to seek interim relief in any jurisdiction.

Before filing a claim, you agree to contact us and allow 30 days for good-faith resolution, except where urgent injunctive relief is reasonably required.

23. General

If any provision is held unenforceable, the remaining provisions continue in effect. You may not assign these Terms without our consent. We may assign them in connection with a reorganization or sale of assets. These Terms, together with the policies and agreements referenced in them and your order confirmation, are the entire agreement for the subject matter and supersede prior discussions.

Our failure to enforce a provision is not a waiver.
